KAMPALA, UGANDA – The Land Division of the High Court has stopped the construction of a commercial building belonging to city businessman Moses Kalungi along Nassar Road.
The injunction came after a suit was filed by Uganda Railways Corporation after a boundary opening of the building had encroached 18 metres into Uganda Railway land.
The building was set up in December last year when city businessman Kalungi commenced excavation of land situated on plots 43 and 41 along Nassar Road in Kampala. Uganda Railway Cooperation realised that the businessman had encroached on its land and brought the matter to him, which he disagreed with, and further advised him that boundary opening be undertaken before further construction, which prompted them to seek court intervention.
Justice Rashidah Batanula of the Land Division of the High Court issued an order halting further construction of the building.
“A temporary injunction does issue restraining the respondent, her servants, employees, assignees, agents, and/or successors in title from further alienating, transferring, wasting, constructing, excavating, selling, and/or entering into any part of the suit land comprised in FRV440 FOLIO 29 Plot 45-51 Nasser Road measuring approximately 0.51 acres, land at Nasser Road, and carrying on activities whatsoever on suit land until the disposal of the final suit pending before this Honourable Court.” Justice Batanula issued the injunction.
