KAMPALA, Uganda | A law firm has petitioned the Director of Public Prosecutions, Jane Frances Abodo, for the continued incarceration of former Special Operations Commander Nickson Agasirwe.
Agasirwe was arrested on May 22 after being suspected of being involved in the murder of Assistant Director of Public Prosecutions Joan Kagezi in 2015.
In their petition to Abodo, Akampurira and Partners requested that Agasirwe be released unconditionally from the flying squad headquarters in Kireka, Kampala, where he is being held until the ODPP office has adequate proof.
“If no action is taken to release our client, we will have no choice but to seek redress in the court of law,” the law firm petitioned, stating that “keeping our client in detention indefinitely and in such inhuman conditions is unconstitutional and unacceptable.” the law firm petitioned
They also cautioned that Agasirwe’s ongoing detention without being brought before a court or previously charged in a court of law is a violation of Uganda’s constitution’s articles 23(4) and 44.
“To date, our client has been detained for 15 days without being brought before the court or formally informed of the reason for his arrest.”
Due to similar allegations that were the subject of a general court-martial investigation in 2022, they further stated that they believe it is odd and irrational to subject their client to further enquiries.
Additionally, the petition contained a nolle prosequi issued by the Director of Public Prosecutions in 2024, according to the law firm.
Nixon was arrested as a result of incriminating testimony from Daniel Kiseka Kiwanuka, a former UPDF soldier who was found guilty of killing Kagezi and named Nixon as the mastermind of the attack. The International Division of the High Court later sentenced Kiwanuka to 35 years in prison.
