KAMPALA, Uganda | Kawempe North member of parliament Elias Luyimbazi Nalukoola has filed a notice of appeal against a court decision that nullified his election victory on Monday.
This comes hours after Justice Bernard Namanya nullified Nalukoola’s victory and ordered the Electoral Commission to conduct a fresh election.
Through his lawyers, PACE Advocates, “Take notice that the Appellant, Luyimbazi Elias Nalukoola, is dissatisfied with the judgement of HON. JUSTICE BERNARD NAMANYA from the High Court of Uganda, Civil Division, on the 26th day of May 2025. [He] intends to appeal to the Court of Appeal of Uganda the judgement passed against the Appellant.”
Justice Bernard Namanya ruled that 16,640 voters were disenfranchised when the Electoral Commission failed to tally results from 14 polling stations following disruptions, in violation of Sections 64, 71, and 76 of then, which affected the outcome of the parliamentary by-election for Kawempe Division North held on 13 March 2025, citing election offences and non-compliance with the Parliamentary Elections Act (Cap. 177).
